Dear Friends in our Craft Spirits Community:

What happened to the lazy, hazy days of summer? Somehow, they escaped the team of committee volunteers (read below to meet one of our newest board of directors) and staff at ACSA. Our pace seems to keep even keel with the heat and humidity: it keeps rising and we remain on fire with advocacy efforts and plans for future events.

Let’s start with advocacy. Did you see the exchange between ACSA and WSWA, drawing laser sharp attention on the plight of the craft distilling industry? Simply put, craft distillers are struggling to stay alive, let alone turn a profit. While inflation and economic headwinds may contribute to the struggle, additional factors are at play. Outdated, highly stifling state legislation and regulatory chokeholds prevent small business manufacturers from selling product. Market access is pinched. ACSA interacted with and educated lots of state reps at the National Conference of State Legislatures this month. Working with state guilds, numerous tools for routes to market were illuminated. It is and will continue to be slow going as much of our industry continues to be misunderstood. There are some notable successes, however. A huge shout-out to the New York State Distillers Guild for its recent DtC win and Alaska for promulgating rules and regulations in support of its DtC legislation. That makes a total of nine states plus the District of Columbia that allow DtC. Nine down and only 41 to go.

Can we find common ground with wholesalers? I remain optimistic despite the consolidation and continued difficulty our members face in finding and building a relationship with this tier. ACSA has long called the tool of DtC a distribution on-ramp, allowing producers to build a brand so that a distributor can clearly assess the spirits potential. Makes sense, right? It is a common-sense solution to an escalating problem. With more brands entering the market and fewer wholesalers to distribute, the math just doesn’t work. Legislators are now beginning to better understand a flawed business model which largely contributes to obstacles for growth for our small business manufacturing sector.

ACSA continues to grapple with and explore paths to enhance the business climate for America’s craft distillers. If you plan to come to Capitol Hill during ACSA’s Legislative Fly-in, you’ll share your stories as to why relief is critical for our innovative sector. Besides learning more about nutritional labeling and the status of dietary guidelines, you’ll be the first to educate lawmakers on a new bill—designed by distillers—which we expect will be introduced just days before we reach the halls of Congress. Looking forward to the holidays? Join us at our American Craft Spirits Festival (a consumer event) at Binny’s Beverage Depot on Nov. 13 if you want to pour your spirits in Chicago. Introduce store reps, trade media and consumers to your holiday releases or flagships, but act fast as table sales will quickly fill. And, as an added benefit, send us your best cocktail recipe (or purchase an ad) to be included in a second release of our cocktail book. Next, mark the dates and put aside the funds to take your team to our annual convention.

Finally, as ACSA believes strongly in conscious inclusion—making sure our craft spirits industry is open to everyone regardless of race, color, gender, sexual orientation or physical disability—the STEPUP Foundation continues to solicit applications for interns, mentors, DSPs and wholesalers to participate in this award-winning hands-on training internship program. The “WE” in “We are Craft Spirits” must continue to represent the consumers who enjoy our spirits. Learn more about STEPUP and how YOU can make a difference. As I write this note, the temps are soaring past the 90-degree mark. Even when the temps drop, we’ll still be hot to work on issues to make our industry a better place for all our American craft distillers and those who support them.

Roundup: Market Access and DtC in the News

This month, ACSA is applauding legislation in two states that aims to help modernize the craft spirits marketplace.

On Aug. 20, ACSA joined the New York Distillers Guild in applauding Gov. Kathy Hochul for signing Senate bill 2852-A, which makes New York the latest state to allow certain distilled spirits manufacturers to ship their products via direct-to-consumer (DtC) shipping.

And earlier this week, ACSA welcomed the final rules to implement Alaska Senate Bill 9, enacted in 2022, to provide additional market access for craft distillers in and out of the state.

“The Alaska rules becoming effective this week along with enactment of New York’s DtC legislation certainly gives the craft distiller community a reason to celebrate and offers a ray of hope in a challenging marketplace,” says ACSA CEO Margie A.S. Lehrman. “And while there is certainly momentum behind this movement, there is still so much work to be done to increase the number of tools that can be used by craft distillers to engage and continue to build relationships with customers. We will continue the fight to modernize the spirits industry in a responsible way.”

Much of that work to be done was highlighted in a Food & Wine story titled “U.S. Craft Distilleries Are in Crisis” by Jake Emen. The story laid bare significant challenges facing craft spirits producers, including economic and legislative headwinds. While some critics of the story assert that market conditions today are challenging, ACSA respectfully argues that with inflation, rising costs of living and market uncertainty plaguing the entire economic landscape, we cannot afford to overlook the need for new tools for craft distillers—particularly those that allow them to sell in the way today’s consumer demands.

Q&A with Adam Polonski of Lost Lantern

Adam Polonski and Nora Ganley-Roper of Lost Lantern

Adam Polonski is a co-founder of Lost Lantern, an award-winning independent bottler of American whiskey based in Vergennes, Vermont. The company’s tagline and mission are one in the same: shining a light on the independent spirit.

Adam was recently elected to ACSA’s Board of Directors. He answered a few questions for this newsletter and also joined us—along with co-founder Nora Ganley-Roper—for an episode of The Craft Spirits Podcast.

ACSA: What motivated you to run for a board seat and/or what are your top priorities for your term?

Adam Polonski: I’m in an unusual position as a board member in that I’m not a distiller, and never will be. I’m a former spirits journalist and whiskey reviewer (primarily for Whisky Advocate) and the co-founder of Lost Lantern Whiskey, an independent bottler of American whiskey. My job is to hunt down and source the best whiskey from small distilleries all across the country. We visit every distillery we work with in person, and over the last five years I’ve visited over 200 distilleries all across the country.

That has given me a fairly unusual bird’s-eye view of the industry, and I’m continually talking to distillers and founders about their successes, their frustrations and their struggles. This in fact is what motivated me to run for a board seat. I see that we all are in the same boat together, facing many similar challenges, but in many cases we don’t realize that we aren’t the only ones.

My top priorities for my term include helping ACSA grow its membership, pushing for improved market access and media recognition for craft spirits, and finding ways to help distillers share knowledge and come together better.

Who are some people or other companies that inspire you?

I have deeply admired the team at St. George Spirits (Lance Winters, Dave Smith, Lucy Farber and many others!) for years. They have built a strong and independent distillery that is centered on breaking boundaries and creating incredibly high-quality spirits that help redefine what spirits can be. But more than that, they’ve built an incredible company culture, centered on trust, inclusion and a deep commitment to quality and process. Strong culture, great people and amazing spirits–it’s a winning combination that has allowed them to remain independent for more than 40 years.

What’s the most important thing you’d want people to know about Lost Lantern?

We aren’t a distillery and never will be (although we do have our own DSP and warehouse in Vermont). We source all our whiskey, but we do it a little differently than most, and for a different reason. We proudly label the source distillery or distilleries on the front and back label of all our whiskies. Our mission is to help whiskey lovers discover the country’s best whiskies and distilleries, and to help share the stories of the distilleries and founders who are changing the world of whiskey.

What’s currently going on and coming up at Lost Lantern that you’re excited to share?

We recently released our Summer Collection, called the Summer of Bourbon, which has the simple message that great bourbon now comes from all across the United States. And this fall, we’ll be releasing a collection of 10-year-old whiskies from craft distilleries. Both releases push back against mistaken conceptions we still hear regularly: that bourbon can only be made in Kentucky, and that all craft whiskey is young. There is amazing whiskey out there with low age statements (we’ve released less than 1-year-old whiskey ourselves!), but we also want to celebrate those who have been able to age their whiskey for much longer.

Any advice or words of wisdom for your peers in the craft spirits community?

Most broadly, I hope everyone knows they aren’t alone. Times are tough right now across the industry, and that can feel very isolating. But the truth is, we’re all in this together. There may be some bumps in the road, but craft spirits have a very bright future ahead and will always be an important part of the industry landscape.

More specifically, I strongly encourage distilleries to build closer relationships with national and local media and with large online spirits fan communities/influencers. Whether you work with a PR firm or not (and you should if you can afford it!), it’s always helpful to cultivate journalists and influencers who are personally excited and emotionally invested in your story. Working with the media is a long game that goes beyond any one single story, but it can pay huge dividends over the long term. If this isn’t something you’ve ever done, start off by inviting local reporters to visit your distillery, and stay in touch with them whenever you do something new and exciting!
