WASHINGTON, D.C. (February 20, 2026)—Today, the United States Supreme Court (“SCOTUS”), in a 6-3 ruling, issued its opinion that the tariffs imposed under the International Economic Emergency Powers Act by President Donald J. Trump are unlawful.
ACSA welcomes and applauds this decision. Tariffs on many of our packaging inputs, together with retaliatory actions taken by other countries, are just a few of the headwinds facing America’s craft distillers. Eliminating those uncertainties will create a more stable business environment for craft distillers who were disproportionately impacted by previous sudden cost increases related to trade wars.
We would continue to urge the Administration to work with the Congress to develop a sound economic trade policy to advance the interests of the U.S. We remain steadfast in our belief that spirits should not be a part of trade wars.
We look forward to working with the Congress and the Administration to assist small businesses that have been unduly hurt by unlawful tariffs, including relief for the cost of imported inputs, that are unavailable in the U.S.
